Mining grouping, as regulated by the Mining Code and its complementary norms, offers miners the possibility to unify their operations in contiguous areas, optimizing production and resource management.
What is Mining Grouping?
It is the merging of two or more mining concessions under the same ownership, exploring the same mineral substance, in areas of the same deposit or mineralized zone, forming a single mining unit.
Legal Basis:
- Decree-Law No. 227/1967 (Mining Code): Article 53 authorizes the National Mining Agency (ANM) to allow the formation of mining groupings.
- Decree No. 9.406/2018 (Regulation of the Mining Code): Article 37 details that the holder may request unification, following the procedures and requirements established by the ANM.
- DNPM Ordinance No. 155/2016: Includes mining grouping as one of the mining titles and as one of the processes involving inspection costs.
How to Request a Mining Grouping?
- Requirements: The applicant must be the holder of two or more mining concessions, exploring the same mineral substance.
- Areas: The areas must be in the same deposit or mineralized zone.
- Application: The request is addressed to the ANM, following the procedures established in ANM Resolution.
- Documentation: The application must contain a technical and economic justification for the formation of the grouping, detailing the expected benefits and available resources.
- Annual Mining Report (RAL): The holder of the mining grouping must submit the consolidated RAL by March 15 of each year.
- Assignment or Transfer: In the event of assignment or transfer of mining rights in mining groupings, the process is analyzed considering each individual title, without deconstructing the grouping for processing the endorsement request.
Important Considerations
- The formation of a mining grouping is subject to approval by the ANM, which will assess the technical and economic viability of the unification.
- The exploitation of the grouping must observe the applicable norms and regulations, including environmental and safety issues.
- The ANM may establish additional requirements for the formation and operation of mining groupings.
By optimizing operations and simplifying management, mining grouping is a strategic alternative for the sustainable development of the sector.
