Mining companies can negotiate debts with discounts of up to 70%

The Brazilian Federal Government confirmed that companies with non-tax debts registered with the National Mining Agency (ANM) will have an unprecedented opportunity to regularize their situation. Until December 31st of this year, it will be possible to negotiate these debts through the “Desenrola Brasil” program, an initiative coordinated by the Federal Attorney General’s Office (PGF) of the Attorney General’s Office of the Union (AGU).

The “Desenrola Brasil” program was created by Law No. 14,973/2024 and offers special conditions for paying debts to federal public agencies and foundations, such as the Brazilian Institute of Environment and Renewable Natural Resources (IBAMA), the National Department of Transport Infrastructure (DNIT), and the National Agency of Land Transport (ANTT).

Through the extraordinary transaction provided for in Article 22 of the law, debtors can receive discounts of up to 70%. However, it’s important to note that the debtor’s profile, the length of time the debt has been registered, the chosen payment term, and the scope of the negotiated debts will all be taken into consideration.

Benefits of the Program

One of the main advantages offered by the program is the installment plan of up to 145 months, in addition to a significant discount for one-time payments.

Negotiation conditions are adaptable to the debtor’s profile, which includes individuals, micro-entrepreneurs (MEI), micro and small businesses, educational institutions, and charitable organizations, such as the Santa Casa de Misericórdia.

Furthermore, non-tax debts, such as fines and other financial penalties registered with the ANM, can be negotiated, even if they are under enforcement, involved in lawsuits or arbitration processes, included in previous installment plans, or with suspended enforceability.

In such cases, the program also allows the inclusion of debts in administrative disputes, provided they meet the requirements established in the public notice.

How to Participate

To join “Desenrola Brasil,” requests must be submitted exclusively through the online address supersapiens.agu.gov.br, using a GOV.BR account with a silver or gold security level. Interested parties can follow a step-by-step guide to access the system and check their debts through an explanatory video available on YouTube.

The deadline for joining the program is 7 PM (Brasília time) on December 31, 2024. Experts warn that this is a unique opportunity for companies and other debtors to regularize outstanding financial obligations, taking advantage of more favorable conditions and, in many cases, avoiding the worsening of sanctions or administrative blocks.

The program aims to encourage financial regularization and provide relief to strategic sectors, such as mining, while ensuring greater efficiency in debt recovery for public coffers.
