The Brazilian National Mining Agency (ANM) is conducting two public consultations to improve key regulations in the mining sector. Announced in the Federal Official Gazette on November 18, 2024, the consultations seek input from society and industry professionals on proposed regulations addressing two central topics: total and partial withdrawal of mining license applications and financial guarantees for the execution of mine closure plans.
Withdrawal of Mining License Applications
Public Consultation ANM No. 7/2024 was launched to discuss and regulate procedures related to the total or partial withdrawal of mining license applications. The proposal aims to clarify the requirements and implications of such withdrawals, ensuring efficient management of licenses while promoting greater transparency and agility in mining processes.
The contribution period runs from November 25, 2024, to January 8, 2025. ANM advises that any requests to extend the deadline must be submitted at least five days in advance and include a justification. Contributions can be sent through the Participa Mais Brasil portal, accessible via the ANM’s official website.
Financial Guarantees for Mine Closure
Public Consultation ANM No. 6/2024 focuses on regulating the procedures for submitting financial guarantees required to ensure the resources needed for executing mine closure plans.
This measure complies with Article 13 of Law No. 13,575/2017, which mandates that mine operators secure funds for closing mining activities, minimizing environmental and social impacts after operations cease.
This consultation will also be open for contributions during the same period, from November 25, 2024, to January 8, 2025. ANM highlights that guidelines and detailed information on how to participate in the public consultations are available on its institutional portal.
