The Agência Nacional de Mineração (National Mining Agency) – ANM provides a list after 1st Instance applications of the municipalities benefiting from art.2, § 2, VII of Law 8.001/1990 (included by Law 13.540/2017 – CFEM affected by mining activities), regarding railroads.
What is CFEM?
It is the Compensação financeira pela Exploração de Recursos Minerais (Financial Compensation for the Exploration of Mineral Resources) CFEM – or also called mining royalties.
Differently from mineral producers, the affected municipalities are those that do not produce, but in some way are impacted by mining, either by harboring ports, railroads or pipelines.
Of the total CFEM collected, 60% goes to the producing municipalities, 15% to the producing state, 15% to the affected municipalities, and 10% to the Union.
List of CFEM
The list of affected beneficiaries is revised every April by the ANM, as well as the size of the impact suffered in the previous year, which becomes the compensation amount, passed on directly to the prefectures.
The ANM has also made available the final list of beneficiaries impacted by port operations, both for the period 05/2022 to 04/2023.
Deadline for Resource
The resource must be directed to the National Distribution, Intelligence and Revenue Planning Division (DINDIPR).
The Division will evaluate the possibility of reviewing the decision of rejection, in case it is maintained, it will send the records for a final decision from the ANM Board of Directors, according to art.15 of ANM Resolution 102/2022.
Interested parties may file an appeal in 2nd Instance to the list of railroads within 10 (ten) days as of July 26, 2022.
The omitted cases will be settled by the Superintendência de Arrecadação e Gestão de Receitas (Superintendence of Collection and Revenue Management) – SAR, in conjunction with DINDIPR.
