The Department of Mines and Energy, through the National Mining Agency (ANM), released Resolution ANM No. 145, in an edition dated 06/12/2023, which brings modifications to the procedures for investigating infractions and penalties related to non-compliance with obligations stipulated in the mineral sector legislation.
The Director-General of ANM, Roger Romão Cabral, relying on legal provisions, including Law No. 13,575 of 2017, and considering the Internal Regulations of the Agency, has deliberated on the changes that will come into effect from the publication date of this Resolution.
Key Changes in Resolution ANM No. 145
- Reduction in calculation bases: Article 68 of Resolution ANM No. 122 of 2022 has been amended, determining a 60% reduction in the calculation bases concerning penalties of severity level four or lower. This reduction will apply until March 31, 2024.
- Retrospective applicability: Resolution ANM No. 145 establishes the retrospective application of the reduction factor, covering the period between December 01, 2023, and the publication date of the said Resolution.
These changes represent an update in the criteria for calculating penalties in the mineral sector, aiming for greater suitability and expediency in the process of investigating infractions.
