ANM Resolution earns regulatory quality seal from the Ministry of Economy

ANM (National Mining Agency) Resolution No. 85/2021, which deals with the use of tailings and waste rocks from mining, won the gold seal of regulatory quality standard from the Ministry of Economy.

Among the criteria evaluated, the Resolution met eight of the ten parameters analyzed, among which are transparency of the process, social participation and efficiency.

The Regulatory Quality Seal Program – in the gold, silver, and bronze categories – is in its first edition and aims to recognize and give visibility to federal regulators for adopting the best international practices in the regulatory process and contribute to facilitate the country’s access as an effective member of the Organization for Economic Cooperation and Development (OECD).

According to the ANM’s Superintendent of Regulation and Regulatory Governance, Yuri Moraes, the resolution, besides following the best practices of normative drafting, brought incentives for companies in the sector to take advantage of mining tailings.

The norm brought legal security to mining companies and an environmental gain for the entire Brazilian society, he adds. In less than a year since the norm went into effect, several successful tailings processing projects are already underway.

The rule also brings economic incentives for companies that use the tailings. These mining companies pay half the value of the Financial Compensation for Mineral Exploration (CFEM) on sales of the material obtained through the use of tailings and waste rock.
